[email protected]   For release on August 6, 2010     CAMPBELL REAL ESTATE AGENT CONVICTED OF MULTI-COUNTY RESIDENTIAL PROPERTY FRAUD SCAMS   This week, 50-year old Robert Carrillo, a real estate agent from Campbell, was convicted of five felony counts in several real estate fraud scams that involved six residential properties in Santa Clara, San Mateo, and Alameda counties. Carrillo entered no contest pleas to grand theft, forgery, and impersonation of a notary public charges as to three separate victims who suffered over $100,000 in losses through the scams.   All three scams had backdrops involving property flipping, or the buying and quick reselling of property for profit. In one instance, Carrillo stole a San Jose man’s identity to acquire title to three residential properties in Santa Clara and San Mateo counties. Carrillo and a co-conspirator, Cesar Emilio Luna (AKA Caceres), placed their own fingerprints in a notary journal and forged the victim’s signature to acquire loans on the properties in the victim’s name. In a separate scheme, Carrillo facilitated the theft of $73,200 in escrow by inducing an unknowing Cupertino victim to sign a letter that authorized the wrongful transfer of the money to Luna. In another case, Carrillo pocketed $45,000 from a Cupertino man in the unconsummated purchase of properties in Saratoga and Cupertino in the man’s name.   As part of the negotiated settlement, Carrillo will receive a one year county jail sentence, but the length of his sentence could be reduced depending on the amount of restitution paid by his sentencing date, which is currently set for January 7, 2011.   There is an outstanding arrest warrant for co-conspirator Cesar Emilio Luna (AKA Caceres).
