408-792-2702   DA: INSUFFICIENT EVIDENCE FOR CHARGES AGAINST FOOTBALL PLAYER
Professional football player Ahmad Brooks will not face prosecution for assault, the District Attorney’s Office announced today.
The incident happened on June 8, 2013. A District Attorney Investigator’s follow-up investigation of the case was completed on July 16, 2013. Assistant District Attorney Karyn Sinunu-Towery prepared an inter-office memo on July 17, 2013. That memo was delivered to the District Attorney today. The four-page memo is being sent along with this release. The contents of the memo were also delivered to the Court.
“I have reviewed the memo and agree with its conclusion,” District Attorney Jeff Rosen said. “Cases are not always what they first appear. The value to a thorough and deliberate investigation is a more complete picture of the facts. We cannot prosecute this case because we cannot prove the crime beyond a reasonable doubt to 12 jurors. To file criminal charges when we do not believe we will obtain a conviction is wrong."
