FROM:  Amy Cornell, Public Information Officer (408) 792-2997   CONTACT PERSON: Bill Butler, Deputy District Attorney (408) 792-2529   For release on January 30, 2008   DOCTOR WHO PERFORMED UNECESSARY SURGERY ON AN ELDERLY PATIENT TO BE SENTENCED TO ONE YEAR IN COUNTY JAIL   41-year old Ali Moayed pled guilty to one count of felony elder abuse and one count of felony insurance fraud on Friday, January 25, 2008. He will be sentenced to one year in county jail on March 7, 2008. In addition, Moayed must pay $50,000 to the California Medical Board for investigative costs, and approximately $15,000 in restitution to Medi-Cal. Additionally, he will be required to perform 100 hours of community service and serve 3-years of probation following his jail sentence. Moayed surrendered his license and can no longer practice medicine in the state of California.   Moayed, a former urologist based in Los Gatos, was convicted of fraudulently obtaining consent from an 87-year old patient for a surgical procedure after falsifying the patient’s pathology report to show he had prostate cancer.   Records indicate that Doctor Moayed falsified the pathology reports of three patients, recommending that all three undergo a “brachytherapy.”  This is a form of radiation therapy that requires the patient to undergo general anesthesia to insert radioactive “seeds” through a needle into or adjacent to the target cancer. The falsification was discovered shortly before the other two patients were to undergo the same procedure.   ###
