(408) 686-3606 For Release on October 30, 2003 DRIVER PLEADS NO CONTEST TO VEHICULAR MANSLAUGHTER Charles Spear pleaded no contest today to vehicular manslaughter with gross negligence and reckless driving causing bodily injury. Mr. Spear caused the death of Rosalie Pena, and injured Rose Castaneda on August 6, 2003. Mr. Spear faces up to six years in prison. The crash occurred on Monterey Road in Morgan Hill, a few short blocks from the site of the Pena family restaurant, the Sinaloa Café. A formal public sentencing hearing will be held in Department 90 of the Santa Clara County Superior Court in San Martin on Tuesday, November 25 at 9:00.
