(408) 792-2997 GRAND JURY INDICTS RAY MCDONALD FOR RAPING AN INTOXICATED PERSON The Santa Clara County Grand Jury this week indicted Ray McDonald on one count of rape of an intoxicated person. The law prohibits sexual intercourse with a person who is too intoxicated to consent. The indictment stems from a December 15, 2014 incident at the 30-year-old former professional football player’s home. The District Attorney’s Office has also charged Ahmad Brooks, a 31-year-old professional football player, with misdemeanor sexual battery. The separate assaults occurred the same evening against the same victim. McDonald will be arraigned on September 25,2015 at the Hall of Justice in San Jose. He faces a maximum of eight years in prison. Brooks faces a maximum of six months in jail. He will be arraigned at a later date. The Grand Jury also indicted McDonald for a May 27, 2015 violation of the court’s Domestic Violence restraining order, which carries a maximum sentence of one year in jail. The Grand Jury declined to indict McDonald on felony false imprisonment and other domestic violence misdemeanor charges stemming from a May 25, 2015 incident with another woman. In light of the grand jury’s decision, the District Attorney’s Office plans to dismiss that criminal complaint. If more information on that incident comes to light, prosecutors will re-evaluate that decision. # # #
