(408) 792-2802   For Release on April 8, 2003   PLEA ENTERED IN WALKER TRIAL   Defendant Janice Walker entered a plea today to a felony violation of Penal Code section 368(b) (Physical Abuse of an Elder) and Penal Code section 368(e) (Embezzlement from an Elder by a Caretaker).  She will be sentenced to two years in state prison.  Additional charges against co-defendant Cheryl Walker were dismissed.   The decision to settle the case was made due to evidence produced during the course of the two-week trial.  1) Additional testing was conducted by the coroner’s office in this case and these new tests demonstrated the possibility of pneumonia being a possible cause in the elderly victim’s death. 2) Toxicology experts confirmed a possible innocent explanation for the presence of drugs in the victim’s system and 3) Grant Walker, Janice Walker’s son and a key witness in the case, admitted forging his mother’s signature and falsely notarizing this signature on a number of key legal documents.   Sentencing will be held on May 2, 2003 before the Honorable Richard J. Loftus, Department 33 of the Superior Court.
