Juvenile Justice Unit
The Juvenile Justice Unit is responsible for reviewing and prosecuting all referrals for juvenile delinquent activity committed in Santa Clara County. This includes screening cases for informal supervision, diversion, and certification to adult court and traditional prosecution.
In addition to these responsibilities, the unit has been instrumental in creating and implementing a number of specialized programs designed to meet the needs of the youthful offender while furthering the primary mission of community safety. These programs include nationally recognized models for drug treatment and domestic violence, as well as the country’s first Mental Health Court.
The Unit has also been at the forefront of fairly and aggressively implementing the provisions of voter implemented Proposition 21. Specifically, serious violent offenders are prosecuted to the fullest extent of the law, including trial in the adult division of the Superior Court, when appropriate; probation violators are held accountable for failing to abide by court orders; and first time offenders are offered an opportunity to participate in the most successful Deferred Entry of Judgment program in the state. This program allows a juvenile to have his conviction expunged if he meets certain court ordered conditions, such as paying restitution, obeying all laws, attending school, completing community service hours, if ordered, and favorable quarterly reports from the Juvenile Probation Department.
