FROM: Dolores Carr, District Attorney (408) 299-3099   For release on March 25,2008   Request for Criminal Investigation/Fraudulent Signatures Complaint   Dear Members of the Public:   This letter is in response to the public urging that the Santa Clara County District Attorney’s Office investigate an alleged “fraud” that occurred when a person recently submitted 92 signatures to the San Jose City Council related to the naming of the area on Story Road “Little Saigon.”  I understand that the “Little Saigon” naming controversy is a source of tremendous frustration for many members of our community.  However, this office may only investigate and prosecute criminal violations of state law.  In this matter at hand, the submission of the 92 signatures to the San Jose City Council by a private person not under oath does not appear to violate any state law.   Moreover, it is my understanding that the San Jose City Council has asked the San Jose City Attorney to investigate this matter and submit a report of their findings and recommendations for any possible remedial action.  The District Attorney’s Office will monitor the situation and if we perceive any violations of state criminal law, we will not hesitate to act.   Thank you again for contacting us with your thoughts and concerns.  Please be assured that the District Attorney’s Office shares your concerns about the integrity of the governmental deliberative process.  If you have any further questions or concerns, please do not hesitate to contact me.  I may be reached by the following:   Santa Clara County District Attorney Dolores Carr 70 West Hedding Street, West Wing San Jose, CA  95110   telephone (408) 299-3099 e-mail [email protected]   ###
