(408) 792-2826    For release on Monday, June 1, 2009   TODD DAVID BURPEE CONVICTED IN PALO ALTO SEXUAL ASSAULT OF 17-YEAR-OLD HIGH SCHOOL STUDENT   Twenty-two-year-old Todd David Burpee was found guilty by jury on Thursday, May 28, 2009 of the October 2007 kidnapping and sexual assault of a 17-year-old high school student in Palo Alto.  The case was prosecuted by Deputy District Attorney James Leonard.   Burpee was found guilty of two counts of felony assault; two counts of assault with intent to commit rape; one count of kidnapping to commit sexual assault and one count of sexual penetration by force.  All of the charges carried an enhancement of “great bodily injury,” which the jury found to be true.    Burpee was acquitted of the remaining charge of attempted murder.  His next court date is scheduled for 7-10-09 at 9:00AM in Department 53 before the Honorable Judge Griffin Bonini.  A sentencing date will be set at that time.  Burpee could face a maximum sentence of 42-years-to-life in state prison.   Any questions can be directed to Nick Muyo, Public Information Officer, at 792-2826.   ###
